Mention emotional intelligence in bank accounts: is it the jackpot for banks?

The new status of the individual entrepreneur
The reasons for this change? To protect the personal assets of self-entrepreneurs. Law No. 2022-172 of February 14, 2022 in favor of independent professional activity (published in JORF No. 0038 of February 15, 2022) created a unique situation for individual entrepreneurs, protecting their personal property. This new situation in particular is to make the personal assets of the individual entrepreneur unfit to be seized by his professional creditors. Before May 15, 2022, if the auto-entrepreneur is unable to pay the debts of his company, his creditors (Urssaf, CGSS, Banks, Suppliers, Subcontractors) have the right to confiscate his personal property (other than your main residence). The law defines an individual entrepreneur as a natural person who carries out one or more independent professional activities in his own name (Article L. 526-22 of the Commercial Code). With respect to this definition, the new status of individual entrepreneur applies specifically to a trader registered with the RCS, a tradesman registered in the Directory of Professions, and a liberal professional registered with the URSSAF. The law states that a creditor can only initiate enforcement proceedings against an individual entrepreneur debtor over the assets of the estate over which the creditor has a general lien.
Mention emotional intelligence or individual entrepreneur in all documents
Since May 15, 2022, all documents issued by a self-employed person must mention EI or Sole Proprietorship. This new reference is part of EIRL’s replacement of a single Sole Proprietorship case that combines a small business (more commonly known as Self Employed) with a traditional Sole Proprietorship. So this applies in particular to the following documents:
- Company Seal,
- purchase orders,
- Contracts (CGU, CGI, Service Provision Contracts),
- promotional material,
- Correspondence with institutions (Ursaf, tax services, etc.),
- First Name, Last Name followed by EI or Sole Proprietorship on RIB of Bank Account.
RIB pro account with EI: not all banks are ready
Your bank account must also mention Sole Proprietorship/EI. However, the majority of banks are not ready for this procedure. Thus, Boursorama, Monabanq, Caisse d’Epargne … answer their customers that this procedure is not yet viable. Other banks like Shine, Qonto, manager.one, etc. Already updated. On the URSSAF side, the message passed is that we should not panic. This procedure is in progress and is mainly related to the registration of new companies.

What are the risks of an independent business whose bank account does not have an EI stated?
The maximum fine is 750 euros, but it is not the most important. What matters is that the creditors will be authorized to request forfeiture of the amount owed on the bank account if no mention of EI appears in the drafting of the account.
